Southampton Justice Court Records

The Southampton Justice Court is the local court for the town. Justice Courts in New York are similar to Town Courts. They handle traffic violations, parking matters, code enforcement cases, and criminal charges at the misdemeanor and violation level. Small claims up to $3,000 are also part of their work. Two elected justices preside over the court.

Records from the Justice Court are held by the court clerk. You can request case information by calling or visiting. A case number makes the search quick. The clerk can provide copies of dispositions, bail records, and case status information. If you do not have a case number, a name search may work, but it takes longer. Copy fees are $0.65 per page across all New York courts.

Southampton Justice Court records are generally not available through the state's online portals. WebCriminal covers Suffolk County District Court but not every local justice court. Public Access to Southampton Court Records

New York court records are presumed open to the public. Judiciary Law Section 255 says clerks must keep court records organized and open for inspection. You do not need to state a reason. Walk into the clerk's office and ask to see a file.

Sealed records are the exception. Criminal cases ended in the defendant's favor get sealed under CPL 160.50. Family Court records are largely confidential in Suffolk County. Custody and juvenile cases are restricted to the parties. Matrimonial files in Supreme Court are also off limits to the public. The Clean Slate Act may seal additional older convictions going forward.

To challenge a denial of access, CPLR Article 78 gives you the right to file a special proceeding in Supreme Court. You have four months from the denial. The court or clerk must then show a legal basis for keeping the records closed.
