Oswego County sits in the 5th Judicial District with Onondaga, Oneida, Herkimer, Madison, and Lewis counties. Supreme Court takes civil cases over $25,000, divorce proceedings, and other big matters. County Court handles felony criminal cases and civil disputes up to $25,000. The clerk keeps files for both.
The county has a moderate caseload compared to its larger neighbors like Onondaga. The clerk's office can usually help you find records without too much wait time. Have a case index number ready if you can. It makes the search faster. The staff can also look up cases by party name if that is all you have.
Oswego City Court Records
Oswego City Court is the only city court in the county. It handles misdemeanors, violations, civil cases up to $15,000, and small claims up to $5,000 within the city of Oswego. The court has its own clerk. Records are kept at the court, not with the County Clerk.
Criminal cases that begin in city court as felonies get moved to County Court after a grand jury indictment. The early records stay with city court. County Court picks up from there. If you are tracking a felony case, check both courts for the complete file.
Town courts across Oswego County handle traffic tickets, local code violations, and small disputes. Each town court has its own justice and clerk. Records from these courts are public unless sealed. Contact the specific town court for records from those cases.

Surrogate's Court covers wills, estates, guardianships, and adoptions. Most probate records are open to the public. You can look at estate filings, will documents, and guardianship papers at the clerk's office. Adoption records are sealed.
Matrimonial actions filed in Supreme Court are also confidential. Only the spouses and their lawyers have access to the divorce file. This is the same rule that applies in every New York county.
Access Rules for Court Records
Court records in Oswego County are generally open to the public. Judiciary Law Section 255 says clerks must maintain records and make them available for public inspection. You can walk in and ask to see any file that is not sealed or restricted by law. No reason is required.
Criminal records sealed under CPL 160.50 are not available. Dismissed and acquitted cases get sealed automatically. The Clean Slate Act also allows sealing of certain older convictions. Family Court and matrimonial records have their own restrictions.
If you are denied access to a record you think should be public, bring a CPLR Article 78 proceeding in Supreme Court. The deadline is four months from the denial. The custodian bears the burden of showing the restriction was proper.
